If you search for the term ‘divorce separation’ on the internet then you will find a lot of information about both of these topics. It is a sad fact of society today that more people are seeking either divorce or separation from their spouse, which is perhaps why there is so much information available.

Whilst most people believe that if you are separated this will always lead eventually to divorce, this is not necessarily the case. Although it does have to be said that it is true in the majority of situations. A separation is a non legal-binding trial end to a relationship. As such it is seen as a temporary step to allow you or your spouse a bit of freedom to get sorted out and their life back into order. After a period of being apart - normally around 4 - 6 months - both parties may try living together again to see how things work out.

Alternatively, a separation also occurs where the two parties were cohabiting to begin with and never legally formalized their relationship. In cases such as this, the separation is normally seen as the formal end to the relationship.

Divorce though is the final step in making the separation from your spouse legal. It is the final division of all items, material, financial, children or otherwise, between the two parties which enables both parties to separate and begin to build their different lives.

For both divorce and separation it is possible to draw up official papers in order to agree the division of items between the two parties. For divorce these papers are known as divorce papers and for separation they are known as a separation agreement.

If your current relationship is not working, the process of having a trial separation or filing immediately for divorce will be a painful process for both parties. To make the process less painful it helps if you are able to discuss it amicably with your spouse. Consulting a marriage guidance counsellor or a neutral third party may also help, either by saving your relationship or helping both of you to realize that your relationship is beyond repair and that the best way forward is to end it.
